176 June 22, 2016 No. 291 IN THE COURT OF APPEALS OF THE STATE OF OREGON In the Matter of M. L. B., A Person Alleged to have a Mental Illness. STATE OF OREGON, Respondent, v. M. L. B., Appellant. Lane County Circuit Court 15CC01475; A159116 Maurice K. Merten, Judge. Submitted May 6, 2016. James A. Palmer filed the brief for appellant. Ellen F. Rosenblum, Attorney General, Benjamin Gutman, Solicitor General, and Judy C. Lucas, Assistant Attorney General, filed the brief for respondent. Before Duncan, Presiding Judge, and DeVore, Judge, and Flynn, Judge. PER CURIAM Reversed. Cite as 279 Or App 176 (2016) 177 PER CURIAM Appellant seeks reversal of a judgment committing her to the Oregon Health Authority for a period not to exceed 180 days pursuant to ORS 426.130. She argues that, contrary to the trial court’s ruling, the state failed to prove by clear and convincing evidence that, because of a mental disorder, she is a danger to herself and unable to provide for her basic needs. The state concedes that the evidence is legally insufficient to support the involuntary commitment and that the judgment should be reversed. We agree, accept the state’s concession, and reverse the judgment of commitment. Reversed.
