PER CURIAM.

¶1 This is a proceeding by the petitioners, Wilcox Oil and Gas Company and Massachusetts Bonding and Insurance Company to review an award made by the State Industrial Commission in favor of Leonard McFee. The order from which the proceeding is prosecuted was entered on the 20th day of May, 1946. The Secretary of the State Industrial Commission certified that a copy of said order was sent to the parties affected on the same date.

¶2 A motion to dismiss has been filed for the reason that the cross petition of Leonard McFee was not filed until October 7, 1946. The motion to dismiss must be sustained. In Hurley v. State Highway Commission,

¶3 The cross petition in error of Leonard McFee is dismissed.
