W concur: e Mr. Justice John C. Sheehy, specially concurring: I concur in the opinion, but disagree that an amend- ment to the pleadings to include waiver is permissible in this case. Waiver is a voluntary and knowing relinquish- ment of a right. I do not see how waiver, if waiver occurred, by the Union could be binding upon the individual teacher-members of the Union on their severance. While the Union is the agent of the teachers in the bargaining which results in the contract, it can hardly be the agent of its members for the purpose of waiver when the school board violates the terms of the contract.
