Commonwealth v. Gilmore

The Supreme Court reversed the decision of the court of appeals reversing the trial court's order revoking Defendant's probation and imposing her cumulative sentence of thirty years' imprisonment in accordance with her consolidated guilty pleas, holding that the trial court made sufficient oral and written findings supporting its decision to revoke Defendant's probation.

In reversing and remanding the trial court's decision, the court of appeals held that the trial court's findings were not adequate under Ky. Rev. Stat. 439.3106. The Supreme Court disagreed, holding that the trial court complied with section 439.3106 and the holding in Commonwealth v. Andrews, 448 S.W.3d 443 (Ky. 2014), in making sufficient oral and written findings supporting its decision to revoke Defendant's probation.
