Defendant Caruthers' Motion to Dismiss 79 is GRANTED, and Plaintiff's claims against Defendant Caruthers are DI SMISSED. Plaintiff's Motion to Amend 69 is DENIED. Defendant Potter's Motion to Dismiss 57 is GRANTED, and Plaintiff's claims against Defendant Potter are DISMISSED. All of Plaintiff's claims having now been dismissed, the Cle rk is directed to close the file. Any other pending Motions are denied as moot. The jury trial set for March 6, 2012, and the pretrial conference set for February 17, 2012, are canceled. This Order shall constitute the final judgment in this case pursuant to Fed. R. Civ. P. 58.
