Therefo re, the court agrees with, and wholly ADOPTS, the magistrate judge's findings and recommendations in the Report (ECF No. 35), which is incorporated herein by reference. Accordingly, the court GRANTS Defendants' motion to dismiss (ECF No. 25) and this action is DISMISSED without prejudice based on Plaintiff's failure to exhaust his administrative remedies.IT IS SO ORDERED.
