Further, the application to proceed in forma pauperis in 10-cv-17 is granted, that case numbers 09-cv-995 and 10-cv-17 are consolidated as case number 09-cv-995, that the complaint in 10-cv-17 shall be docketed as a supplemental complaint in 09-cv-995 and the Clerk of Court shall close 10-cv-1 7. Further, the remaining motions in 10-cv-17 and 10-cv-454 are denied as moot and the Clerk of Court is to return any monies that were received for filing fee in 10-cv-454. Further, the Clerk of Court is directed to send plaintiff with this order a copy of the complaint and amended complaint in 09-cv-995 and the complaints in 10-cv-17 and 10-cv-454, a blank section 1983 complaint form and the insturctions for preparing an amended complaint, a copy request form and the docket report in 09-cv-995 . Further in the event plaintiff fails to file a third amended complaint by 11/18/20, the remaining action 09-cv-995 shall be dismissed with prejudice without further order of the Court and leave to appeal to the court of Appeals as a poor person denied. Further, the Clerk of Court shall amend the official caption of the action in 09-cv-995. Further, the Clerk of Court shall docket this Order in all three above-referenced cases. Signed by Hon.
