Court Description: MEMORANDUM AND OPINION: The plaintiff's ADA discrimination claim is dismissed pursuant to 28 U.S.C. Section 1915(e)(2)(B). The plaintiff's Title VII claim will proceed. The defendants Patrick Athy and Diana Cimino are dismissed because t he remedial provisions of Title VII do not provide for individual liability. See Spiegel v. Schulmann, 604 F.3d 72, 79 (2d Cir. 2010). The United States Marshals Service is respectfully directed to serve the summonses, complaint, amended c omplaint and this order upon the defendant without prepayment of fees. The Clerk of Court is directed to send a copy of this order to the plaintiff. The case is respectfully referred to Magistrate Judge Orenstein for pretrial supervision.
