Against the School 10 District, the plaintiff alleged that he was subjected to 11 discrimination and a hostile work environment because of his 12 race, in violation of Title VII and the NYSHRL.2 13 The defendants filed a motion for summary judgment on all 14 claims, which the district court granted. 15 dismissed the discrimination claims because it found that Mr. 16 Tolbert had failed to establish a prima facie case of 17 discrimination because he had not suffered an adverse employment 18 action and had failed to raise an inference of discrimination. 2 The district court The defendants suggest, without elaboration, that the plaintiff did not timely exhaust his administrative remedies before the Equal Employment Opportunity Commission with respect to his Title VII claims. The defendants do not explain this argument in their brief. The district court noted that an argument of non-exhaustion had been raised but never decided it.
