Annotate this Case
US Court of Appeals for the Sixth Circuit - 919 F.2d 739 (6th Cir. 1990) Dec. 6, 1990

Before RYAN and ALAN E. NORRIS, Circuit Judges, and JOINER, Senior District Judge.*

ORDER

Columbus Jasper Southerland, Jr., a pro se Tennessee resident, appeals the district court's order dismissing his appeal from an order of the United States Bankruptcy Court for the Middle District of Tennessee. The case has been referred to a panel of the court pursuant to Rule 9(a), Rules of the Sixth Circuit. Upon examination of the record and briefs, this panel unanimously agrees that oral argument is not needed. Fed. R. App. P. 34(a).

Southerland's extremely terse appeal filed in the district court states only that he seeks review of an order filed by the bankruptcy court on April 24, 1989. The order of April 24, 1989, dismissed Southerland's adversary proceeding against the trustee in bankruptcy for failure to state a claim upon which relief could be granted. Southerland's appeal did not identify the issues on appeal, did not specify any errors of law or fact on the part of the bankruptcy court, and did not challenge the bankruptcy court's findings of fact.

After a review of the meager record before it, and in light of Southerland's illusory assertions, the district court noted that the record appeared without blemish and dismissed the appeal. The district court further noted that the case was illustrative of the shortcomings of a pro se appellant in a bankruptcy case. Southerland has filed a timely appeal.

Upon review, we hereby deny Southerland's requests for counsel and for a transcript and affirm the district court's judgment for the reasons stated in the district court's order filed April 11, 1990. Rule 9(b) (5), Rules of the Sixth Circuit.
