IN THE SUPREME COURT OF THE STATE OF DELAWARE SANDY DRUMMOND, Defendant Below, Appellant, v. MILES LEDERER and CATHERINE LEDERER, Plaintiffs Below, Appellees. § § § § § § § § § § § § No. 56, 2023 Court Below–Justice of the Peace Court of the State of Delaware C.A. No. JP16-22-005489 Submitted: March 14, 2023 Decided: March 31, 2023 ORDER On February 15, 2023, the appellant, Sandy Drummond, filed a notice of appeal from a Justice of the Peace Court order dated February 10, 2023. The Senior Court Clerk issued a notice, sent by certified mail, directing Drummond to show cause why this appeal should not be dismissed based on the Court’s lack of jurisdiction to consider an appeal from the Justice of the Peace Court. Postal records indicate that the postal service made a delivery attempt at the address provided by Drummond to the Court on February 18, 2023, but no authorized recipient was available to sign for delivery. On March 3, 2023, the Senior Court Clerk reissued the notice to show cause by first-class mail. The notice was returned to the Court as unable to be forwarded. To date, Drummond has not responded to the notice to show cause or reported any change of address to the Court. Dismissal of the appeal is therefore deemed to be unopposed. NOW, THEREFORE, IT IS ORDERED, under Supreme Court Rules 3(b)(2) and 29(b), that the appeal be DISMISSED. BY THE COURT: /s/ Gary F. Traynor Justice 2
