IN THE SUPREME COURT OF THE STATE OF DELAWARE JAMES FEGER, Defendant Below, Appellant, v. STATE OF DELAWARE, Plaintiff Below, Appellee. § § § § § § § § § § § No. 13, 2022 Court Below–Superior Court of the State of Delaware Cr. ID No. 2006008546 (S) Submitted: February 4, 2022 Decided: February 15, 2022 ORDER On January 12, 2022, the appellant, James Feger, filed a notice of appeal from the Superior Court’s December 10, 2021 order sentencing Feger for a violation of probation. The Senior Court Clerk issued, by certified mail, a notice directing Feger to show cause why his appeal should not be dismissed as untimely filed.1 Feger received the notice to show cause as evidenced by the undated return receipt that was filed with the Court on January 24, 2022. A timely response to the notice to show cause was due on or before February 3, 2022. To date, Feger has not responded to the notice to show cause. Dismissal of the appeal is therefore deemed to be unopposed. 1 Supreme Court Rule 6 provides that appeals must be filed within thirty days. NOW, THEREFORE, IT IS HEREBY ORDERED, under Supreme Court Rules 3(b)(2) and 29(b), that the appeal is DISMISSED. BY THE COURT: /s/ Gary F. Traynor Justice 2
