On January 13, 2006, John Martin filed a pro se petition for writ of mandamus in this court contending that the Honorable John S. Patterson, Circuit Judge, had failed to set a hearing in a timely manner on a civil complaint filed by Martin. Judge Patterson responded to the mandamus petition, averring that he had recused from the matter and that the complaint was not assigned to his court. It is the responsibility of the petitioner to name the correct respondent in a mandamus action. As Judge Patterson has informed this court that the complaint is not assigned to his court, the petition for writ of mandamus is denied.

Petition denied.
