CR 03-68

PRO SE MOTION TO DISMISS APPEAL [CIRCUIT COURT OF GRANT COUNTY, NO. CR 99-67-1, HON. JOHN COLE, JUDGE]

MOTION GRANTED

In 2001, Billy Reece Crain was found guilty by a jury of five felony offenses for which an aggregate sentence of 120 months' imprisonment was imposed. The court of appeals affirmed. Crain v. State, 78 Ark. App. 153, 79 S.W.3d 406 (2002). Crain subsequently filed a timely petition for postconviction relief pursuant to Criminal Procedure Rule 37.1 in the trial court. The petition was denied, and the record on appeal from that order has been lodged here.

In the instant verified motion, appellant Crain, who is proceeding pro se, asks that the appeal be dismissed. The motion is granted.
