Rickie Earn Berna v. M.D. Reed, Warden
Annotate this Case
ARKANSAS SUPREME COURT
NOT DESIGNATED FOR PUBLICATION
PER CURIAM
MAY 8, 2003
RICKIE EARN BERNA
Appellant
v.
M. D. REED
Appellee
02-569
APPEAL FROM THE CIRCUIT COURT OF LINCOLN COUNTY, LCIV 2001-105-3, HONORABLE FRED D. DAVIS III, JUDGE
PETITION FOR REHEARING DENIED
Appellant petitions for rehearing in this case. He contends that the court's opinion affirming the denial of his pro se petition for writ of habeas corpus contained errors of law and fact. See Berna v. Reed, CR 02-569 (Apr. 10, 2003)(unpublished).
Rule 2-3(g) of the Rules of the Arkansas Supreme Court provides that the petition for rehearing should be used to call attention to specific errors of law or fact which an opinion is thought to contain. A rehearing petition is not intended to afford an opportunity for a mere repetition of the argument already considered. In his petition, however, appellant simply reargues two of the issues raised in his original brief. Accordingly, we deny his petition for rehearing.
Petition for rehearing denied.
