In accordance with the opinion of the Alabama Supreme Court in Ex parte Tulley, [Ms. 1140049, September 4, 2015] ___ So. 3d ___ (Ala. 2015), we reverse the trial court's judgment and remand this case to the trial court for proceedings consistent with that opinion.
