The m o t h e r s t a t e d that she h a d v o l u n t a r i l y s o u g h t s u b s t a n c e - a b u s e t r e a t m e n t w i t h t h e F a m i l y House substance-abuse program a f t e r J u l y 2008 j u d g m e n t . The F a m i l y House required the mother to l i v e the e n t r y of the substance-abuse program i n an o n s i t e facility, and t h e m o t h e r p a r t i c i p a t e d i n t h a t p r o g r a m f r o m J u l y 31, 2008, until F e b r u a r y 2009. The m o t h e r moved i n t o a two-bedroom townhouse in a February 2009 in what she described as quiet n e i g h b o r h o o d . The m o t h e r ' s r e n t was s u b s i d i z e d so t h a t she h a d t o p a y o n l y 3 0 % o f t h e m o n t h l y r e n t due. The m o t h e r w o r k e d as a s e c r e t a r y a t a r e a l - e s t a t e company 30 h o u r s e a c h week, and she e a r n e d a p p r o x i m a t e l y $10.50 The mother had three an h o u r . children: a 14-year-old son, the c h i l d , and an 8 - m o n t h - o l d d a u g h t e r . The 2090397/2090398 mother stated Narcotics that she attended Alcoholics Anonymous and Anonymous m e e t i n g s a n d p a r t i c i p a t e d i n s u b s t a n c e - abuse a f t e r c a r e . Even though rehabilitation the program mother in had February completed 2009, a the drugpaternal g r a n d m o t h e r t e s t i f i e d t h a t she d i d n o t t h i n k t h a t t h e m o t h e r was r e a d y t o r e c e i v e c u s t o d y o f t h e c h i l d because t h e mother had c o m p l e t e d a d r u g - r e h a b i l i t a t i o n program i n 2004 a n d was a r r e s t e d on d r u g - r e l a t e d c h a r g e s 13 months l a t e r . The p a t e r n a l grandmother stated demonstrate t h a t that t h e mother needed she was n o t g o i n g t o r e l a p s e more time to i n t o drug use because o f t h e mother's h i s t o r y o f making e f f o r t s t o improve h e r s i t u a t i o n a n d t h e n " b a c k s l i d i n g . The a d j u s t i n g t o h e r home when t h e c h i l d child had visited t h e mother f o r a p p r o x i m a t e l y 12 weeks b e t w e e n September 2008 a n d t h e t i m e o f t h e o r e t e n u s h e a r i n g . The m o t h e r a d m i t t e d t h a t provided any grandparents, support f o r the b u t she s t a t e d that 10 child to her family she h a d n o t the paternal had p r o v i d e d 2090397/2090398 clothing f o r the c h i l d . The mother paternal stated that grandparents she t r i e d n o t t o speak w i t h t h e a t a l l because i t made h e r e x t r e m e l y uncomfortable. According the child t o the mother, s u p e r v i s e d v i s i t s at the paternal t e n s e and she a v o i d e d g r a n d p a r e n t s ' home were that situation with extremely s o a s n o t t o harm t h e c h i l d . The m o t h e r a d m i t t e d t h a t t h e o n l y c o m m u n i c a t i o n s h e h a d w i t h t h e p a t e r n a l g r a n d p a r e n t s was a t v i s i t a t i o n e x c h a n g e s a n d t h a t she d i d n o t c a l l t h e p a t e r n a l g r a n d p a r e n t s w h i l e t h e y had custody o f t h e c h i l d . B u t , he testified, after monitoring the mother's rehabilitation c l o s e l y , he was c o n v i n c e d t h a t t h e m o t h e r s h o u l d have c u s t o d y of the c h i l d returned to h e r . According to the maternal g r a n d f a t h e r , t h e mother i s a good mother t o h e r youngest c h i l d and he w o u l d n o t h e s i t a t e t o n o t i f y t h e j u v e n i l e c o u r t i f he saw s o m e t h i n g about a b o u t t h e m o t h e r t h a t c a u s e d h i m t o be c o n c e r n e d the welfare of the c h i l d . The maternal grandfather t e s t i f i e d t h a t he b e l i e v e d t h a t t h e c h i l d w o u l d e a s i l y a d j u s t to living adjustment the with the mother because there was never an period f o r the c h i l d during v i s i t a t i o n periods with mother. Standard o f Review "On a p p e l l a t e r e v i e w o f c u s t o d y m a t t e r s , t h i s c o u r t is l i m i t e d when t h e e v i d e n c e was p r e s e n t e d o r e t e n u s , and, i n such c i r c u m s t a n c e s , a t r i a l c o u r t ' s d e t e r m i n a t i o n w i l l n o t be d i s t u r b e d ' a b s e n t an abuse of d i s c r e t i o n o r where i t i s shown t o be p l a i n l y a n d p a l p a b l y w r o n g . A review o f t h e r e c o r d r e v e a l s t h a t t h e r e was evidence to support the j u v e n i l e c o u r t ' s i m p l i c i t f i n d i n g t h a t the mother was f i t t o c a r e f o r t h e c h i l d . The m o t h e r had cared f o r her evidence i n d i c a t e d that eight-month-old daughter for the that c h i l d ' s e n t i r e l i f e and t h a t n e i t h e r t h e m a t e r n a l g r a n d p a r e n t s nor the paternal grandparents thought i t necessary, for the w e l f a r e o f t h a t c h i l d , t o s e e k t o remove h e r f r o m t h e m o t h e r ' s c u s t o d y .
