The following pertinent facts were presented to the j u v e n i l e c o u r t . DHR h a d a s s i g n e d the f a t h e r , b u t n o t h i n g to the a caseworker t o i n v e s t i g a t e i n t h e r e c o r d on a p p e a l i n d i c a t e s t h a t T h e m o t h e r ' s h u s b a n d i s n o t an A m e r i c a n c i t i z e n , b u t , a t t i m e o f t h e f i n a l h e a r i n g , he h a d a " g r e e n c a r d . Regarding the "material-promotion" McLendon standard, p r o n g o f t h e Ex o u r supreme c o u r t has parte explained: "'[This] i s a r u l e of repose, a l l o w i n g the c h i l d , whose w e l f a r e i s paramount, the v a l u a b l e b e n e f i t o f s t a b i l i t y and t h e r i g h t t o p u t down i n t o i t s e n v i r o n m e n t t h o s e roots necessary f o r the c h i l d ' s healthy g r o w t h i n t o a d o l e s c e n c e and a d u l t h o o d . The d o c t r i n e requires that the party seeking modification prove to the court's satisfaction that material changes a f f e c t i n g the c h i l d ' s welfare since the most r e c e n t d e c r e e d e m o n s t r a t e t h a t c u s t o d y s h o u l d be d i s t u r b e d t o p r o m o t e t h e c h i l d ' s b e s t i n t e r e s t s . The p o s i t i v e good b r o u g h t a b o u t b y t h e m o d i f i c a t i o n must more t h a n o f f s e t the i n h e r e n t l y d i s r u p t i v e e f f e c t caused by u p r o o t i n g t h e c h i l d .
