The d e c i s i o n o f t h e a r b i t r a t o r s h a l l be f i n a l a n d b i n d i n g a n d may be e n t e r e d a s a j u d g m e n t i n any S t a t e o r F e d e r a l c o u r t of competent jurisdiction. Arbitration shall i n c l u d e , b u t n o t be l i m i t e d t o , t h e d e t e r m i n a t i o n b y the a r b i t r a t o r o f t h e scope o f a r b i t r a t i o n and t h e arbitrability of controversies or claims. The p a r t i e s acknowledge and agree t h a t t h e t r a n s a c t i o n s c o n t e m p l a t e d by t h i s Agreement, which i n c l u d e t h e use o f m a t e r i a l s a n d components f r o m o u t o f s t a t e i n t h e home, i n v o l v e i n t e r s t a t e commerce a s t h a t t e r m i s u s e d i n t h e F e d e r a l A r b i t r a t i o n A c t , 9 U.S.C. § 1 e t s e q . The s i t e o f s u c h a r b i t r a t i o n s h a l l be M o b i l e County, Alabama. "[John Howard] and [Wittmann] agree and u n d e r s t a n d t h a t t h e y choose a r b i t r a t i o n i n s t e a d o f l i t i g a t i o n t o r e s o l v e d i s p u t e s . The p a r t i e s f u r t h e r u n d e r s t a n d t h a t t h e y have a r i g h t o r o p p o r t u n i t y t o l i t i g a t e disputes through a court, but they p r e f e r to resolve their disputes through arbitration, e x c e p t as p r o v i d e d h e r e i n . The p a r t i e s v o l u n t a r i l y and k n o w i n g l y w a i v e a n y r i g h t t h e y h a v e t o a j u r y trial. The d e c i s i o n o f t h e a r b i t r a t i o n s h a l l be f i n a l a n d b i n d i n g on t h e p a r t i e s a n d a c c e s s t o j u d i c i a l f o r u m i s f o r e c l o s e d , e x c e p t t o e n f o r c e an arbitral decision. "[John Howard] and [Wittmann] agree and u n d e r s t a n d t h a t a l l d i s p u t e s a r i s i n g under case law, s t a t u t o r y law, and a l l o t h e r laws i n c l u d i n g , w i t h o u t limitation, a l l contract, tort, and property d i s p u t e s , whether o r n o t such d i s p u t e s a r i s e under o r a r e r e l a t e d t o t h i s c o n t r a c t , w i l l be s u b j e c t t o b i n d i n g a r b i t r a t i o n i n a c c o r d w i t h t h i s Agreement." 3 2090051 ( E m p h a s i s added.) pertinent part, Pages 6 a n d 7 o f t h e w a r r a n t y b o o k l e t , i n stated: "Any a n d a l l c l a i m s , d i s p u t e s a n d c o n t r o v e r s i e s by o r b e t w e e n [Wittmann a n d J o h n Howard] ... a r i s i n g from o r r e l a t e d t o t h i s Warranty, t o t h e s u b j e c t Home, t o a n y d e f e c t i n o r t o t h e s u b j e c t Home o r t h e r e a l p r o p e r t y on w h i c h t h e s u b j e c t Home i s s i t u a t e d , o r t h e s a l e o f t h e s u b j e c t Home b y [John H o w a r d ] , i n c l u d i n g w i t h o u t l i m i t a t i o n , any c l a i m o f b r e a c h o f contract, negligent or intentional misrepresentation or n o n d i s c l o s u r e i n t h e inducement, e x e c u t i o n o r performance o f any c o n t r a c t , including this a r b i t r a t i o n a g r e e m e n t , a n d b r e a c h o f any a l l e g e d d u t y o f g o o d f a i t h a n d f a i r d e a l i n g , s h a l l be settled by b i n d i n g arbitration. Agreeing to a r b i t r a t i o n means y o u a r e w a i v i n g y o u r r i g h t t o a jury t r i a l . II "... Any disputes concerning the interpretation or the enforceability of this arbitration agreement, including without l i m i t a t i o n , i t s r e v o c a b i l i t y or v o i d a b i l i t y f o r any cause, t h e scope o f a r b i t r a b l e i s s u e s , a n d a n y d e f e n s e b a s e d upon w a i v e r e s t o p p e l o r l a c h e s s h a l l be d e c i d e d b y t h e a r b i t r a t o r .
