This Court granted Dietz leave to proceed in forma pauperis, Doc. 5, and he timely paid his initial partial filing fee. This Court now screens Dietz's complaint. • Dietz claims that the defendant's last name is spelt as Bauerle. Doc. 6 at 1. In this order, this Court will refer to the defendant by the correct spelling of her last name. ^ At the time Dietz filed his complaint, he was incarcerated at the Yankton Community Work Center.
