Dietz moved for leave to proceed in forma pauperis and provided his prisoner trust account report. Docs. 2,3. This Court granted Dietz leave to proceed in forma pauperis, Doc. 5, and he timely paid his initial partial filing fee. This Court now screens Dietz's complaint. • Dietz claims that the defendant's last name is spelt as Bauerle. Doc. 6 at 1. In this order, this Court will refer to the defendant by the correct spelling of her last name. ^ At the time Dietz filed his complaint, he was incarcerated at the Yankton Community Work Center.
