Syllabus

The fourth and fifth sections of the Act of Congress passed on the 31st of March, 1830, 4 Stat. 392, entitled "An act for the relief of purchasers of public

lands and for the suppression of fraudulent practices at the public sales of the United States" cited and explained.

One who covenants to sell lands which he expects to purchase at such sales cannot afterwards plead his own fraud in obtaining his title from the government in bar of a decree for specific performance of his agreement.
